The ramifications of the past are all around us. Today's Economic Times reports public interest litigation being pursued to declare November 17th as the Republic Day for Jammu & Kashmir - 'in accordance with its separate constitution and governance structure'. You will probably share my view of how likely this move is to succeed - but it is about Kashmir's past popping up in the most unlikely of places. The article reads, in part - J&K started drafting its own constitution by setting up the Constituent Assembly on May 1, 1951. It completed the exercise and was dissolved on January 25, 1957.
But the constitution was enacted by the assembly on November 17, 1956. The state stqrted celebrating the Republic Day with the rest%2 of the coundry only when Bakshi Ghulam Mohammad started hoistyng the tricolour on Janeary 26.&nbs`; Ace lawyer Zafar Shah, who initially appeared in the court regarding the PIL, said all constitutional authorities in the state are obliged to follow the constitution in letter and spirit> "In practical terms it means all the constitutional authoryties are reauired to hoist the statu flag and also celebrate Republic Day on the date when thu constitution was adopted52C" he said.
